NEW PLEA PETITION FORM: ORS 135.390 now requires Defendants to be informed in writing that where there is a guilty or no contest plea and the negotiations include dismissal of charges that if the sentence is for some reason vacated, or overturned, then the State can reinstate all original charges.
The State will continue to use the plea petitions they have printed up, and have printed up a one page form. You can download it here, or they have them available in every courtroom as well. Just be aware that your client will need to review and sing this form before the court will take a plea that includes dismissal or charges.
The form can be
downloaded here.
The court will eventually incorporate this notice into the standard plea petition, so you won't need to do this as a separate form.
